BitConnect founder Satish Kumbhani has been indicted by a San Diego jury for allegedly orchestrating a global cryptocurrency Ponzi scheme that involved approximately $2.4 billion taken from investors.
BitConnect was a fraudulent cryptocurrency investment platform launched in 2016 that the DOJ said reached a peak market capitalization of $3.4 billion.
Kumbhani managed to convince investors to contribute to the company’s lending program, which he said involved proprietary technology called “BitConnect Trading Bot” and “Volatility Software.” Kumbhani falsely told investors that he could guarantee profits by using investor funds to trade cryptocurrency based on the volatility of the market.
BitConnect ended up simply paying the earliest investors with money taken from investors who joined later on.
“This indictment alleges a massive cryptocurrency scheme that defrauded investors of more than $2 billion,” said US Attorney Randy Grossman.
The regulator claimed that in 2017 and 2018, the five promoted and sold securities through the BitConnect lending program, which promised investors returns as high as 40%. Marketing consisted of YouTube content, social media, and “Testimonials.” The promoters each earned between $475,000 and $1.3 million in commission.
US national Joshua Jeppesen was also charged as an alleged liaison between BitConnect and the platform’s promoters, earning himself a reported $2.6 million in the process.

Russia May Use Cryptocurrency To Try And Evade Sanctions-But Here’S Why That Will Be Hard

As governments around the world release an onslaught of measures to punish Russia for its invasion of Ukraine, a growing number of experts warn that Russia will almost certainly turn to cryptocurrency to help evade sanctions, though it could prove only minimally successful.
“When countries come under heavy sanctions, they get desperate,” David Carlisle, the director of policy and regulatory affairs at Elliptic said in a Monday post, echoing other experts in warning Russia will “Undoubtedly” make an effort to use crypto to help minimize the impact of sanctions.
Though crypto exchanges in the U.S., Europe and Asia will likely stop nearly all dealings with Russia, Carlisle says there are still some exchanges that are complicit in facilitating illicit activity, such as the SUEX and Chatex services sanctioned by the U.S. last year after facilitating more than $350 million in crypto transactions for Russia-based criminals.
Perhaps the “Most attractive option” for energy-rich Russia would be the use of cryptocurrency mining, which already occurs in the vast Siberia province, to generate assets that can be converted into cash or used to pay for imports, Carlisle says, adding that Iran has reportedly used mining proceeds to help evade sanctions.
With a $1.4 trillion banking sector, “There is simply no way Russia can use crypto alone” to fully evade the effect of sanctions, Carlisle acknowledged Monday, pointing out that even “Prolific” nation-state crypto users like Iran and North Korea have “Only” amassed about $1 billion in crypto each, but he says likely efforts could still be useful for sanctioned businesses or oligarchs.

While a company’s share repurchases are generally intended to be bullish for its stock price, there are sometimes reasons for concern.
A company that uses buybacks to create the appearance of quick growth in earnings per share may not be a company worth owning.

If any director, officer or employee of the company is in possession of material, nonpublic information about the company, the company should not be repurchasing shares.
If the company is repurchasing outside of a Rule 10b5-1 trading plan, it should limit its purchases to open window periods when officers and directors are able to buy and sell securities of the company.

Where Rule 10b-18 purchases are made on a company’s behalf by a broker-dealer that is not an electronic communication network or other alternative trading system, that broker-dealer is permitted to access ECN or other ATS liquidity in order to execute repurchases on behalf of the company on that day.
SEC Proposes New Share Repurchase Disclosure Rules
The proposal would establish new Form SR for reporting issuer share repurchases and enhance existing periodic disclosure.
The Securities and Exchange Commission today proposed amendments to its rules regarding disclosure about an issuer’s repurchases of its equity securities, often referred to as buybacks.
“Share buybacks have become a significant component of how public issuers return capital to shareholders,” said SEC Chair Gary Gensler.
The proposed rules would require an issuer to provide a new Form SR before the end of the first business day following the day the issuer executes a share repurchase.
Form SR would require disclosure identifying the class of securities purchased, the total amount purchased, the average price paid, as well as the aggregate total amount purchased on the open market in reliance on the safe harbor in Exchange Act Rule 10b-18 or pursuant to a plan that is intended to satisfy the affirmative defense conditions of Exchange Act Rule 10b5-1(c). The proposed amendments also would enhance existing periodic disclosure requirements regarding repurchases of an issuer’s equity securities.
Specifically, the proposed amendments would require an issuer to disclose: the objective or rationale for the share repurchases and the process or criteria used to determine the repurchase amounts; any policies and procedures relating to purchases and sales of the issuer’s securities by its officers and directors during a repurchase program, including any restriction on such transactions; and whether the issuer is making its repurchases pursuant to a plan that it intends to satisfy the affirmative defense conditions of Exchange Act Rule 10b5-1(c) and/or the conditions of the Exchange Act Rule 10b-18 non-exclusive safe harbor.
The proposed rules apply to issuers that repurchase securities registered under Section 12 of the Securities Exchange Act of 1934, including foreign private issuers and certain registered closed-end funds.

AMD Announces New $8 Billion Share Repurchase
