United States Files Suit Against Drug Manufacturer Regeneron For Paying Kickbacks Through Co-Pay Foundation
BOSTON – The U.S. Attorney’s Office announced today that the government has filed a civil False Claims Act complaint against drug manufacturer Regeneron Pharmaceuticals, Inc., of Tarrytown, N.Y. The complaint alleges that Regeneron paid tens of millions of dollars in kickbacks for its macular degeneration drug Eylea, using a foundation as a conduit to cover co-pays for Eylea.
“According to the allegations in today’s complaint, Regeneron funneled tens of millions of dollars in kickbacks through a third-party foundation to ensure that few Medicare patients paid a co-pay on Eylea and that physicians who prescribed and purchased the drug did not have to collect Medicare co-pays from their patients,” said United States Attorney Andrew E. Lelling.
The complaint alleges that, in 2012, soon after the launch of Eylea, Regeneron considered how much to pay a foundation that covered Medicare co-pays for patients taking macular degeneration drugs.
Regeneron’s senior management was willing to pay the foundation only enough to cover Medicare co-pays for Eylea patients.
As Regeneron’s former Chief Financial Officer put it, Lucentis patients were “Genentech’s problem.” Moreover, Regeneron senior management wanted assurances that the company’s payments to the foundation would generate a handsome ROI. To satisfy senior management, the complaint alleges, Regeneron employees repeatedly contacted the foundation to learn the amount of money the foundation would need to cover the co-pays of Eylea patients only.
Over the course of 2013 and through the beginning of 2014, Regeneron paid the foundation exactly what it said it needed to cover Medicare expenses for Eylea patients only.
As the executives knew, the company was getting frequent Eylea-specific reports from the foundation and then using that data to correlate the company’s payments to the foundation with the foundation’s spending on co-pays for Eylea.

Police say a man has been charged following a high-speed chase that required the diversion of a commercial airplane and ended with a collision involving a police vehicle in Langley, B.C. Abbotsford police say in a news release that an RCMP helicopter was following a sport utility vehicle with mismatched licence plates Tuesday that was later confirmed to be stolen.
They say the Mounties alerted them to the chase and their own officers attempted a traffic stop on the ground, at which point the driver sped away.
Police say the chopper followed the SUV and worked with air traffic controllers at Abbotsford’s airport to redirect an incoming Swoop Airlines flight that was in the helicopter’s flight path.
Police allege the SUV was observed driving into oncoming traffic to pass vehicles, using the shoulder of the road, going through red lights and stop signs, and driving at high speeds that put other motorists at risk.
An hour after the chase began, they say the SUV collided with a police vehicle in nearby Langley, but Abbotsford police say neither the suspect nor officer were injured.
They say the suspect drove a few more blocks, then fled on foot and was taken into custody with help from police dogs.
A 39-year-old Surrey man has been charged with flight from police, dangerous operation of a motor vehicle, possession of stolen property over $5,000, breach of probation and prohibited driving.

In countries like Indonesia, for example, the government and governmental authorities, together with all the healthcare professionals and stakeholders, are taking a very proactive approach in assessing their existing healthcare infrastructure and realising there are a lot of areas that need investment.
In many ways, the impact on healthcare from Covid-19 has been the same in most countries – both developed and emerging it’s just that it has highlighted by how much the healthcare ecosystems of emerging countries lag than those in developed countries.
GE Healthcare announced recently that it signed a 10-year partnership with U.K.-based Circle Health Group.
Circle Health and GE Healthcare look to improve patient outcomes across Circle’s national network of more than 50 hospitals in the United Kingdom, with the agreement covering the provision of medical equipment, installation, services, consultancy and financing, according to a news release.
Circle is the largest independent healthcare provider in the U.K., which is dominated by the government’s National Health Service.
“Our partnership with GE Healthcare is a major step towards realizing that ambition.”
In the partnership, GE Healthcare will offer a range of medical equipment over the 10-year period, plus approximately $70 million in financing for the acquisition of the equipment, provided by GE Healthcare Financial Services.
GE will also work with construction contractors on the installation of equipment to ensure they are designed around the needs of Circle’s clinicians, while the agreement includes an exclusive servicing contract to maintain all of Circle’s medical imaging equipment, including technology not provided by GE. Circle remains in the midst of integrating IT systems acquired in the 2020 purchase of BMI Healthcare, with GE providing digital consultancy on that and the integration of electronic patient records.
“The future of healthcare is in partnerships like this,” GE Healthcare EMEA GM of Partnerships and Solutions John Deverill said.

Moves to take Aeroflot flights out of global distribution are the latest measures against Russia’s aviation industry after most of the western world closed airspace to Russian aircraft.
The travel sector is among many industries suspending ties with Russia over its invasion of Ukraine.
In addition to impacts in aviation, tour companies and cruise lines have halted and rerouted operations involving Russia.
There’s likely one final action that can level, instantly, Russian commercial aviation.
If they cut off the airlines, would that be business they’d ever get back? On the other hand, they could also worry about Russian hacking in response to shutting down service.

In the United States, cholangiocarcinoma affects about 8,000 people per year.
Targeted therapy: Targeted therapy is aimed at the changes in cancer cells that help them grow, divide, and spread. In some cholangiocarcinomas, the cancer cells have changes in the FGFR2 gene, which helps the cancer cells grow out of control.
Scientists have found several changes in important genes in cholangiocarcinoma, such as FGFR2 and IDH1, that may help cancer cells grow out of control.
Doctors estimate cholangiocarcinoma survival rates by how groups of people with this cancer have done in the past.

People with chronic liver disease, whether in the form of viral hepatitis, alcoholic liver disease, or cirrhosis of the liver due to other causes, are at significantly increased risk of cholangiocarcinoma.
A cholangiocarcinoma occurring at the junction where the left and right hepatic ducts meet to form the common hepatic duct may be referred to eponymously as a Klatskin tumor.
Radiation therapy appears to prolong survival in people with resected extrahepatic cholangiocarcinoma, and the few reports of its use in unresectable cholangiocarcinoma appear to show improved survival, but numbers are small.

At presentation, patients are often jaundiced and may have a palpable gallbladder because of bile duct obstruction distal to the cystic duct.

Ownership of Beckwith-Bemis, a manufacturer of plastic coated fabrics, films and adhesives, has returned to Quebec with the purchase of the company by Blair McIntosh.
McIntosh recently purchased the company from a group of American shareholders.
Beckwith-Bemis was established in Sherbrooke in 1917.
McIntosh says he wishes to shift the focus of the company from internal re-engineering towards product development, marketing and sales and service.

The coalition of eight suburbs fighting the railway merger of the Canadian Pacific and the Kansas City Southern filed on Monday an official request with the federal Surface Transportation Board to block the $31 billion pact.
Bartlett, Bensenville, Elgin, Itasca, Hanover Park, Roselle, Wood Dale and Schaumburg formed the Coalition to Stop CPKC last week in a bid to convince the board that the merger would bring so many additional trains to the Milwaukee West Line that it would dramatically alter life in their communities.
The merger would create the first single-line rail network linking the U.S., Canada and Mexico.
The railroads filed the merger application in October.
The coalition filing says the potential price tag for mitigations in all eight suburbs could reach $9.5 billion, and negate any benefit to the railroads.
If the merger is granted, integrating railroad services is expected to take three years to complete.
In December, a representative from Canadian Pacific responded to a Daily Herald request for comment in an email, saying that they will work hard to be a good neighbor and address potential adverse community impacts, working with the communities through the process.

Elgin and seven other municipalities have joined forces in an attempt to stop plans to merge the Canadian Pacific Railway and the Kansas City Southern Railroad, a move local officials say would adversely impact their communities.
At the news conference, Elgin Mayor Dave Kaptain noted that with the merger trains could potentially block traffic at eight grade crossings, including four in the downtown.
In the Chicago area, Canadian Pacific shares tracks with Metra’s Milwaukee District West and North trains.
Kansas City Southern doesn’t operate in the Chicago region but does cross paths with Amtrak Downstate, near East St. Louis.
Amtrak threw its support behind the merger in January, saying Canadian Pacific has consistently earned top marks for causing the least delay to Amtrak passengers.
In January, Canadian Pacific said in a statement, “While the overall impact of the CP-KCS transaction is unambiguously pro-environment and pro-economic growth, we recognize that we will be increasing the number of trains that operate through some communities. We will work hard to be a good neighbor.”

Canadian Pacific completed its acquisition of Kansas City Southern on Dec. 14, 2021, a historic day for the two iconic companies.
Immediately upon the closing of the acquisition, the shares of KCS were placed into a voting trust with Dave Starling, former KCS President and CEO, appointed as the Voting Trustee.
The trust, which ensures KCS will operate independently of CP, will remain in effect until the U.S. Surface Transportation Board issues its decision on the companies’ joint railroad control application to create Canadian Pacific Kansas City, the only single-line railroad linking the United States, Mexico and Canada.
Expected benefits from the business combination will not be realized until the STB approves CP’s control of KCS’ railroads.
Upon obtaining control approval from the STB, the two companies will be integrated fully over the ensuing three years, unlocking the benefits of the combination.
CP and KCS have jointly filed a railroad control application with the STB regarding the proposed transaction to create CPKC. The comprehensive control application provides an overview of the proposed operational integration of the CP and KCS rail networks, the impact of that combination on the companies’ finances and labour needs, and the anticipated competitive and other benefits that will flow from providing shippers with new and better transportation alternatives.
The STB has created a project web site for information about the board’s environmental review of the proposed combination.
The new railroad will be known as Canadian Pacific-Kansas City with a 20,000-mile network, nearly 20,000 employees, and an annual revenue of about $8.7 billion.
The Kansas City Southern’s story is actually quite recent when compared to the railroad industry as a whole; the road’s immediate ancestry began on January 8, 1887 with incorporation of the Kansas City Suburban Belt Railroad, promoted by Arthur Stilwell.
While the KCS was never a big player in the passenger market, like several other roads it did have a few notable trains such as the Southern Belle streamliner which operated between Kansas City and New Orleans.
The KCP&G had been organized on November 6, 1889 and Stilwell had plans for the railroad to provide the shortest route to the Gulf of Mexico, connecting its namesake city with the coast.
Fort Smith & Van Buren Railway: The FS&VB entered the KCS fold on September 30, 1939 when it was formed to acquire the Coal Creek to McCurtain, Oklahoma segment of the former Fort Smith & Western Railroad. The FS&W was chartered on January 25, 1899 and by 1903 opened from Coal Creek to Guthrie, Oklahoma via Oklahoma City.
A few years later, on July 1, 1910, the L&A reached Shreveport, Louisiana thanks to its acquisition of the Minden East & West Railroad. During Kansas City Southern’s, Harvey Couch era, he acquired control of the L&A and LR&N on January 16, 1928.
At about the same time of the aforementioned takeovers, KCS was able to gain complete control of two railroads near, or within Mexico; the Texas Mexican Railway and Grupo Transportación Ferroviaria Mexicana.
