The same month, October 2020, Amazon got a favourable ruling for its plea at the SIAC. In November 2020, Future moved the Delhi High Court against Amazon, alleging interference by the US firm in the deal with RIL. The battle is going on.

“One should look at the statement made by Amazon’s counsel from the lens of ‘worry’. If Amazon can’t get a contractual obligation fulfilled, then the situation is bleak for other foreign investors too,” said K Giri, director, General Empower India, a think tank promoting corporate governance in the country.

The deal between Amazon and Future Coupons was finalised in 2019., nearly a year before Reliance announced its intention to acquire Future Retail.

Because Canada is a federation, taxation in Canada is a shared responsibility between the federal government and the various provincial and territorial governments.

Canadian provinces and territories have the facility to levy taxes on income, consumption and wealth, as does the federal government.

Federal taxes are collected by the Canada Revenue Agency.

Provincial personal income taxes on behalf of all provinces except Quebec, through a system of unified tax returns;.

Corporate taxes on behalf of all provinces except Quebec and Alberta; and.

The Agence du Revenu du Québec collects the GST in Quebec on behalf of the federal government, and remits it to the federal government.

Taxes On Personal Income

Individuals resident in Canada are subject to Canadian income tax on worldwide income.

Relief from double taxation is provided through Canada’s international tax treaties, as well as via foreign tax credits and deductions for foreign taxes paid on income derived from non-Canadian sources.

Non-resident individuals are subject to Canadian income tax on income from employment in Canada, income from carrying on a business in Canada and capital gains from the disposition of taxable Canadian property.

In addition to federal income tax, an individual who resides in, or has earned income in, any province or territory is subject to provincial or territorial income tax.

Quebec has its own personal tax system, which requires a separate calculation of taxable Income.

In addition to the normal tax computation, individuals are required to compute an adjusted taxable income and include certain ‘tax preference’ items that are otherwise deductible or exempt in the calculation of regular taxable income.

A minor child that receives certain passive income under an income splitting arrangement is subject to tax at the highest combined federal/provincial marginal rate, referred to as ‘kiddie tax’.

Your tax bracket is based on “Taxable income”, which is your gross income from all sources, minus any tax deductions you may qualify for.

Your marginal tax rate is the combined federal and provincial income taxes you pay on all sources of income at tax time.

The tax rate varies by how much income you declare at the end of the year on your T1 General Income Tax Return and where you live in Canada.

In order to claim a non-refundable tax credit, you must actually owe taxes – in other words, you must have earned enough income to owe income tax.

Be careful: if you owe income tax and don’t pay, and you don’t make an attempt to work out a payment plan, CRA can seize any refundable tax credits you may be eligible for, and they may take you to court and seize the contents of your bank account.
