On July 16, 2021, the U.S. District Court for the Southern District of Texas held that the DACA policy “Is illegal.” The Court granted summary judgment on plaintiffs’ Administrative Procedure Act claims; vacated the June 15, 2012 DACA memorandum issued by former Secretary of Homeland Security Napolitano; remanded the memorandum to DHS for further consideration; and issued a permanent injunction prohibiting the government’s continued administration of DACA and the reimplementation of DACA without compliance with the APA. The Court temporarily stayed its order vacating the DACA memorandum and its injunction with regard to individuals who obtained DACA on or before July 16, 2021, including those with renewal requests.
Consistent with this order, DHS will continue to accept the filing of both initial and renewal DACA requests, as well as accompanying requests for employment authorization.
Pursuant to the July 16, 2021 order from the Southern District of Texas, DHS is prohibited from granting initial DACA requests and accompanying requests for employment authorization.
Also consistent with that order, DHS will continue to grant or deny renewal DACA requests, according to existing policy.

Hartford Immigration Rally Calls For Change, With Chants Of ‘Down With Deportation’
Crowding the plaza of the Abraham A. Ribicoff Federal Building in Hartford on Thursday, members of Connecticut’s immigrant rights community demanded the closure of U.S. Immigration and Customs Enforcement detention centers and a renewed effort by the White House to deliver comprehensive immigration reform.
During his State of the Union Address Tuesday, President Joe Biden called for an overhaul of the immigration system, including by providing a pathway to citizenship for Dreamers – undocumented immigrants who entered the country as minors – as well as by securing the U.S.-Mexico border against drug smuggling and human trafficking.
“We hear his promises to reduce detention and deportation, we hear him promise to create a ‘fair and humane’ immigration system. We hear him promise to value our immigrant communities, to value our people. And yet, we have seen him do exactly the opposite,” Teresa Quintana, 47, of Manchester, a member of the organization Uniting for a Safe Inclusive Community, told the crowd of more than 50 people.
Participants in the rally – who represented a number of advocacy groups affiliated with the Connecticut Immigrant Rights Alliance – waved signs that read “No fear no hate no ICE in our state,” “Protect kids not borders,” and “Asylum is a human right.”
Javier Villatoro, 26, of New Haven, who came to the United States from Mexico, said that one of his relatives had been deported following a traffic accident and that many immigrants in America live in fear of deportation.
Many who joined the rally said that they had been optimistic that Biden’s election would usher in a new era of security and freedom for immigrant communities, particularly following the Trump administration’s restrictive and repressive approach to immigration.
“A year into the Biden presidency, immigration detention is the same as it always was: racist, inhumane, unnecessary and fundamentally unfair to anyone fighting for the right to stay with their family and community,” he said.
– Jonette Christian: Immigration And America’S Racial Reckoning
Along with copious employment data and multiple immigration and labor historians, Beck tells the story through the writings and speeches of prominent Black leaders such as Booker T. Washington, Frederick Douglass, W.E.B. DuBois, A. Phillip Randolph, and Black-owned newspapers, all of whom doggedly advocated for tight labor policies following the Civil War.
Finally, a mounting demand by Black and labor activists forced Congress to cut immigration numbers in half in 1924.
Blacks began migrating North to fill blue collar jobs in factories deprived of European workers.
Congress ignored the experts they had chosen to consult, and set immigration numbers to please business lobbies wanting more workers and more consumers.
Beck blames Congress, not immigrants, and he doesn’t claim that all problems facing Black communities are driven by immigration.
Immigration numbers have played a largely unrecognized role in forcing vulnerable groups to compete against each other, and Blacks have been especially harmed.

Biden’S Handling Of Immigration Gets Low Marks In Survey Conducted By His Own Pollster
A majority of likely midterm voters – 66 percent – disapprove of President Joe Biden’s handling of immigration issues, according to a new survey conducted by a Democratic firm that has acted as Biden’s chief political pollster.
The survey of 802 likely 2022 voters was conducted February 10-17, by Impact Research, a firm formerly known as ALG polling and founded by John Anzalone, Biden’s chief political pollster.
Briannon Gillis, political director for the Immigrant Justice Fund, the advocacy arm of the National Immigration Law Center, argued that the numbers mean voters would welcome Biden taking more aggressive action before the midterms to overturn former President Donald Trump’s immigration policies.
Biden could take more executive actions and again make immigration legislation a priority before the midterms, Gillis said, but described the administration as being “Overly cautious” and “Tiptoeing” around immigration issues.
Republicans have attacked Biden on immigration from the day he took office – when he proposed a sweeping immigration reform bill that Senate Republicans the next day called a “Nonstarter” – accusing the president of holding an “Open” border policy, a sentiment repeated again and again in conservative media coverage.
Biden does not have an open border policy, and immigrants rights’ groups have instead complained of the administration extending Title 42 and have pressed for Biden to allow more refugees into the country.
In the NILC-commissioned survey, Trump notched much higher marks with his base on how he handled immigration issues than Biden did with his.
Business Groups, Faith Leaders Team Up To Push Congress To Pass Bipartisan Immigration Reforms
A diverse group of faith leaders, job creators and activists launched a new coalition this week to push President Biden and Congress to pass immigration reforms they say are common-sense solutions and are long overdue.
Nearly 30 groups, ranging from the U.S. Chamber of Commerce to the National Association of Evangelicals, banded together to form the Alliance for a New Immigration Consensus.
They kicked off their advocacy campaign with a letter to congressional leaders urging them to act this year on popular reforms to protect certain undocumented immigrants from deportation threats.
“??At no other point in recent history has the need for immigration reform been greater than it is today.
FLORIDA GOP LAWMAKER INTRODUCES SWEEPING IMMIGRATION BILL WITH ‘DIGNIFIED’ PATHWAY FOR LEGALIZATION. At a news conference Wednesday, alliance members were buoyed by Biden’s State of the Union address Tuesday night where he said it was time to “Secure our border and fix the immigration system.”
Immigration problems “Have only gotten worse this year,” said Jon Baselice, Vice President of Immigration Policy at the U.S. Chamber of Commerce.
Rather than seeking a comprehensive immigration bill, the leaders talked of passing smaller legislative solutions on issues with broad public support, such as offering permanent protection for so-called Dreamers, Temporary Protected Status recipients and agricultural workers, as well as improved border security.

Foundation Co-Created By Shopify CEO Donates $26 Million To Canadian Children’S Hospitals
A foundation established by Shopify CEO Tobias Lütke and wife Fiona McKean is donating $26 million to Canada’s 13 acute-care children’s hospitals, including CHEO. “This historic gift recognizes the immense impact of the pandemic on Canadian children, youth, and their families,” according to an announcement of the Thistledown Foundation gift issued Thursday by Canada’s Children’s Hospital Foundations and Children’s Healthcare Canada.
“Through this gift, our hope is that children across Canada will have the best possible care to enable them to feel better soon and get back to the important job of being kids,” McKean, the chair of the foundation, said in the release.
“As an Ottawa resident, I am so proud that our fellow Ottawa citizens have made this truly unprecedented gift – not only helping kids and families from eastern and northern Ontario, western Quebec and Nunavut, where CHEO serves, but in every community across Canada.”
During the COVID-19 pandemic, children and youth have faced school closures, delays in getting essential social, community and health services and separation from friends and family, the organizations said.

Shopify CEO Sends Email To Staff Saying Company Is ‘Not A Family’: ‘We Cannot Solve Every Societal Problem’
The founder and CEO of Shopify, Tobias Lütke, reminded staff that the e-commerce company is a business and “Not a family” in an email last week.
“The very idea is preposterous. You are born into a family. You never choose it, and they can’t un-family you. It should be massively obvious that Shopify is not a family but I see people, even leaders, causally use terms like ‘Shopifam’ which will cause the members of our teams to get the wrong impression.”
Lütke also told staff that not only is the Ottawa-based company not a family, Shopify also cannot “Solve every societal problem.”
“Shopify is also not the government. We cannot solve every societal problem here,” he wrote.
The company-wide email comes after six former Shopify employees made allegations of internal tensions to Business Insider.
A company spokesperson told Insider that Shopify is not trying to silence its employees and welcomes discussion of current events, hinting at recent company policy changes made at software company Basecamp.
Last month, Basecamp banned employees from engaging in societal and political discussion on the company account, arguing that such conversations were unproductive.

Hochul Set To Make Pending ‘Booze-To-Go’ Measure Permanent In New York
BUFFALO, N.Y. – Governor Kathy Hochul is pushing to keep alcohol to go permanent in New York State.
Governor Hochul assured a New York City-based hospitality trade group she is putting together a plan to rework regulations for liquor sales that would allow taverns and restaurants to sell alcohol with takeout meals on a permanent basis.
“This is what kept people afloat during those dark, dark months and years of the pandemic,” said Governor Hochul.
Governor Hochul refers to the massive losses suffered by New York’s hospitality industry during the COVID pandemic as many as 60,000 workers lost their jobs.
Hochul told this New York City hospitality group she is going to make the drinks-to-go concept permanent.
Notarius adds, because of the state’s tight restrictions, those liquor stores in New York City also got hammered.
The alcohol-to-go measure is part of Governor Hochul’s legislative package that includes streamlining the State Liquor Authority’s regulations, and it has a better chance of passage since the governor wrapped it into her state budget resolution.
